Sehr geehrte Damen und Herren,
in wenigen Tagen werde ich in GB von meinen Schulden befreit. Da der endgültige Brexit sich aller Voraussicht nach noch ein paar Wochen/Monate hinzieht (im Falle eines Deals ja sogar noch Jahre), kann ich damit rechnen, dass die englische „discharge“ in Deutschland im Rahmen der noch geltenden EUInsVo anerkannt werden muss. Für mich ist das deshalb vorteilhaft, weil ich u.a. auch Verbindlichkeiten habe, die nach dem Insolvenzrecht in Deutschland nicht restschuldbefreiungsfähig gewesen wären.
Nun meine Frage:
Sofern GB die EU einmal endgültig verlassen hat, also auch die EUInsVo für GB nicht mehr gilt, können dann meine Gläubiger (speziell die eben beschriebenen) nachträglich ihre Forderung nach deutschem Insolvenzrecht geltend machen, nach dem Motto: Nun gilt ja das europäische Insolvenzrecht für GB nicht mehr!
Oder kann ich mich da auf ein Rückwirkungsverbot stützen und darauf beharren, dass mein Verfahren noch vor dem endgültigen Brexit stattgefunden hat. Ich habe da etwas im Netz gelesen, wonach man sich da nicht unbedingt in Sicherheit wiegen kann, da die EUInsVo ja nicht vorsieht, dass ein Mitglied austreten könnte… andererseits würde das ja aber auch bedeuten, dass alle Verfahren der letzten 15-20 Jahre bzgl. der Anerkennung wieder neu zu bewerten wären… können Sie mir da Ihre Einschätzung mitteilen?
